Information for individuals in connection with the processing of personal data on the basis of video surveillance

Pursuant to Article 13 (1) and (2) of the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free flow of such data, and repealing Directive 95/46/EC (RODO), we inform you that:

1. The controller of your personal data processed on the basis of video surveillance without audio recording is Luxtrade II sp. z o. o. (formerly: Luxtrade sp. z o. o. sp. k.), 13 Rybnicka Street, 43 - 200 Pszczyna. Contact to the Administrator: e-mail: kontakt@luxtrade.pl phone: 729 053 053.
2. The Administrator has appointed a Data Protection Officer, who can be contacted in matters related to personal data processing by e-mail: iodo@luxtrade.pl or in writing to the Administrator's registered office address with the note "for DPO".
3. Video surveillance is carried out by the Administrator in order to ensure the safety of people in the monitored area (including the safety of employees) and to protect property.
4. Monitored sites have been marked by the placement of video surveillance information boards.
5. The Data Controller shall, for evidentiary purposes, secure events recorded by the video surveillance system that, among other things, threaten security, destruction and theft of property:
   (a) at the request of third parties;
   (b) at the request of authorities conducting proceedings.
6. Each time security of events recorded by video surveillance is carried out at the written request submitted to the Administrator. Secured data from video surveillance are made available on an external carrier only to authorities conducting proceedings on the recorded event, which act on the basis of separate legal regulations, such as the Police.
7. The legal basis for the processing of personal monitoring data is Article 6(1), letter f) of the General Data Protection Regulation (GDPR), i.e. the processing is necessary for the purposes of legitimate interests pursued by the Administrator or by a third party.
8. The scope of data processed by the Administrator on the basis of video surveillance: silhouette/posture.
9. Video surveillance records will be stored until overwritten (depending on the size of the recordings) up to a maximum of 90 days or until the legal conclusion of proceedings under the law.
10. Your data recorded from the monitoring will not be transferred to a third country or international organization.
11. You have the right to access your personal data and to restrict processing. These rights can be exercised by submitting a request to the registered office of Luxtrade II sp. z o. o. (formerly: Luxtrade sp. z o. o. sp. k.) or by contacting at the data indicated in para. 1 and 2 of this clause.
12. In the event that you consider that the processing of personal data concerning you reasonably violates the provisions of the General Data Protection Regulation of April 27, 2016 [RODO], you have the right to lodge a complaint to the supervisory authority, i.e. the Office for Personal Data Protection, 2 Stawki Street, 00-193 Warsaw, e-mail: kancelaria@uodo.gov.pl, hotline 606-950-000.
13. The Administrator will not transfer personal data processed by means of monitoring to a third country outside the European Economic Area or to international organizations.
14. Data processed through video monitoring will not be subject to automated decision-making, including decisions resulting from profiling.
